Since the end of 2019, it is illegal to sell vaping products to people younger than 21 years.

This ban builds upon legislation signed in July by Governor Cuomo that immediately banned the use of e-cigarettes on all public and private school grounds in New York State. Various studies suggest the vapors from e-cigarettes contain several cancer-causing substances, as well as incredibly tiny particles of tin, chromium, nickel and other heavy metals, which, in large enough concentrations, can damage the lungs. Indeed, a recent survey shows that nearly 60 percent of Americans are now familiar with the sleek, smokeless devices.

Vape products are taxed at the sales tax rate rather than the tobacco or cigarette tax rate. While vape products are not covered by the Smoke-free Air Act, each business can prohibit the use of vape devices indoors, but this is not required by state law. Some public health experts believe that e-cigarettes are an essential alternative to smoking tobacco that can help smokers quit. Others argue that e-cigarettes could be a route into nicotine addiction and point out that their long-term safety has not yet been proven. Such policies are critical in the absence of strong federal regulation of e-cigarettes.
